House Bill 1259
AN ACT TO REQUIRE THE STATE DEPARTMENT OF HEALTH TO ADOPT A REGULATION PROVIDING THAT RURAL HOSPITALS MAY TRANSFER PATIENTS TO LARGER HOSPITALS AND LARGER HOSPITALS MUST ADMIT THE TRANSFERRED PATIENTS, WHEN PHYSICIANS AT THE RURAL HOSPITALS HAVE DETERMINED THAT IT IS MEDICALLY NECESSARY FOR THE PATIENTS TO RECEIVE SERVICES AT THE LARGER HOSPITAL; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The State Department of Health shall adopt a regulation for hospitals to provide that rural hospitals shall be authorized to transfer patients to larger hospitals and larger hospitals shall be required to admit the transferred patients, when physicians at the rural hospitals have determined that it is medically necessary for the patients to receive services at the larger hospital.
SECTION 2. This act shall take effect and be in force from and after July 1, 2023.
