House Bill 1258

AN ACT TO AMEND SECTION 45-1-43, MISSISSIPPI CODE OF 1972, TO REQUIRE LOCAL LAW ENFORCEMENT POLICIES TO PROHIBIT VEHICULAR PURSUITS THAT CROSS OVER INTO OTHER MUNICIPAL JURISDICTIONS BY MORE THAN ONE MILE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 45-1-43, Mississippi Code of 1972, is amended as follows:

     45-1-43.  On or after January 1, 2005, each state, county and local law enforcement agency that conducts emergency response and vehicular pursuits shall adopt written policies and training procedures that set forth the manner in which these operations shall be conducted.  Each law enforcement agency may create its individual policy or adopt an existing model.  All pursuit policies created or adopted by any law enforcement agency must address situations in which police pursuits cross over into other jurisdictions.  Local law enforcement policies shall prohibit vehicular pursuits that cross over into other municipal jurisdictions by more than one (1) mile.  Law enforcement agencies that do not comply with the requirements of this provision are subject to the withholding of any state funding or state administered federal funding.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
