AN ACT TO AMEND SECTION 37-9-21, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE SCHOOL BOARD OF A SCHOOL DISTRICT FROM EMPLOYING A MEMBER OF THE IMMEDIATE FAMILY OF ANY APPOINTED MEMBER OF THE SCHOOL BOARD; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 37-9-21, Mississippi Code of 1972, is amended as follows:
37-9-21. (1) It shall be illegal for any superintendent, principal or other licensed employee to be elected by the school board if such superintendent, principal or licensed employee is either:
(a) Related within the third degree, by blood or marriage according to the common law, to a majority of the members of the school board; or
(b) Related within the first degree, by blood or marriage according to the common law, to any member who is appointed to serve on the school board.
(2) No appointed or elected member of the school board shall vote for any person as a superintendent, principal or licensed employee who is related to that member within the third degree, by blood or marriage, or who is dependent upon that member in a financial way. In addition, no appointed or elected member of the school board may vote for any person as a superintendent, principal or licensed employee if that person is related within the first degree, by blood or marriage, to any appointed member of the school board.
(3) Any contract entered into in violation of the provisions of this section shall be null and void.
SECTION 2. This act shall take effect and be in force from and after July 1, 2012.
