House Bill 1230

AN ACT TO AMEND SECTION 5-1-31, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT RECORDS OF CONSIDERATION OF LEGISLATIVE MATTERS DURING PROCEEDINGS OF THE HOUSE OF REPRESENTATIVES SHALL BE MAINTAINED; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 5-1-31, Mississippi Code of 1972, is amended as follows:

5-1-31. (1) The Secretary of the Senate and Clerk of the House of Representatives shall keep a correct journal of the proceedings of their respective houses, and, on each day, shall read over the journal of the preceding day to their respective houses. They shall number, file and preserve in its proper order, each bill, resolution, memorial or other paper introduced in their respective houses, and carefully engross and enroll all bills, resolutions, memorials and other papers that may be ordered to be engrossed or enrolled. They shall promptly and faithfully discharge all the duties incident to their respective offices.

(2) The Clerk of the House of Representatives shall establish a procedure to record and maintain permanent records of oral debate and consideration of legislative matters by the House membership during those times when the House is convened in session. Such records are not required to be transcribed into written form, but upon the request of any person or entity, including a federal or state agency or court of law, a copy of the medium by which the debate has been recorded shall be made available to the requestor. The Department of Archives and History shall assist the clerk in the storage and maintenance of such records.

SECTION 2. This act shall take effect and be in force from and after July 1, 2010.
