House Bill 1224
AN ACT TO PROVIDE THAT A HOLD HARMLESS CLAUSE IN A MOTOR CARRIER TRANSPORTATION CONTRACT IS AGAINST PUBLIC POLICY AND IS VOID AND UNENFORCEABLE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. A clause, covenant or provision in a motor carrier transportation contract that purports to indemnify or hold harmless the promisee from any liability for loss or damage resulting from the negligence or intentional acts or omissions of the promisee is against public policy and is void and unenforceable.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
