AN ACT TO CREATE THE "VETERAN-OWNED SMALL BUSINESS ENTERPRISE ACT"; TO DEFINE "VETERAN-OWNED SMALL BUSINESS ENTERPRISE"; TO REQUIRE EACH STATE AGENCY, COUNTY AND POLITICAL SUBDIVISION OF THE STATE TO PROCURE AT LEAST .5% OF ITS CONTRACTS FOR THE PURCHASE OF GOODS OR SERVICES FROM VETERAN-OWNED SMALL BUSINESS ENTERPRISES, IN ACCORDANCE WITH STATE AND FEDERAL LAWS REGULATING BIDDING FOR PUBLIC CONTRACTS; TO LIST ACTIONS THAT ARE VIOLATIONS OF THIS ACT; TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  This act shall be known and may be cited as the

"Veteran-Owned Small Business Enterprise Act."

     SECTION 2.  (1)  For purposes of this act, "veteran-owned small business enterprise" means a business that is verified by the Center for Veterans Enterprise of the United States Department of Veterans Affairs as a veteran-owned small business.

     (2)  Each state agency, county and political subdivision of the state shall procure at least five-tenths percent (.5%) of its total contracts for the purchase of goods or services from veteran-owned small business enterprises, in accordance with state and federal laws regulating bidding for public contracts.

     (3)  Each agency, county and political subdivision of the state shall provide a report, at the end of such governmental entities' fiscal year, which lists all veteran-owned small business enterprise contracts granted by the agency, county or political subdivision.

     (4)  No person may knowingly and with intent to defraud, commit the following acts:

          (a)  Obtain, attempt to obtain, or aid another in fraudulently obtaining or attempting to obtain, public money, contracts, or funds expended under a contract to which the person is not entitled under this act;

          (b)  Represent participation of a veteran-owned small business enterprise in order to obtain or retain a bid preference or contract; or

          (c)  Make a statement or subscribe to any statement, declaration or other document that is fraudulent or false as to any material matter.

     (5)  A person who violates the provisions of this act shall be guilty of a misdemeanor for each act of violation, and on conviction shall be fined an amount not to exceed One Thousand Dollars ($1,000.00) per act of violation and imprisonment for a term not to exceed six (6) months for each act of violation.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2011.
