House Bill 1206
AN ACT TO REQUIRE RESIDENTIAL LANDLORDS TO REQUIRE EVIDENCE THAT A PROSPECTIVE TENANT HAS PURCHASED A MOTOR VEHICLE LICENSE TAG BEFORE THE LANDLORD MAY ENTER INTO A RENTAL AGREEMENT WITH THAT PERSON; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Before a landlord may enter into a rental agreement with a prospective tenant in this state, the person seeking to rent the dwelling unit must present to the landlord evidence that the person has purchased a motor vehicle privilege license tag for any vehicle the person owns which is subject to taxation under the Motor Vehicle Privilege Tax Laws (Article 1, Chapter 19, Title 27, Mississippi Code of 1972). The evidence required under this section may be in the form of a valid receipt issued by the Department of Revenue or such other form of evidence deemed satisfactory to the landlord.
This section does not apply to: a prospective tenant to whom a current motor vehicle privilege license tag is issued in the State of Mississippi at the time that the prospective tenant seeks to enter into a rental agreement; or a nonresident who is a student present in the state primarily for educational purposes.
SECTION 2. Section 1 of this act shall be codified as a new section under Chapter 8, Title 89, Mississippi Code of 1972.
SECTION 3. This act shall take effect and be in force from and after July 1, 2011.
