House Bill 1203

AN ACT TO PROHIBIT THE DIVISION OF MEDICAID FROM CONTRACTING WITH ANY OUT-OF-STATE ACUTE CHILD/ADOLESCENT PSYCHIATRIC FACILITY OR PSYCHIATRIC RESIDENTIAL TREATMENT FACILITY TO PROVIDE MEDICAID SERVICES FOR A MISSISSIPPI RESIDENT, UNLESS ALL OF THOSE BEDS IN MISSISSIPPI ARE FILLED OR OTHERWISE UNAVAILABLE FOR USE BY THE MISSISSIPPI RESIDENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Division of Medicaid shall not contract with any facility located outside of this state to provide services in an acute child/adolescent psychiatric bed or a psychiatric residential treatment facility bed for a Medicaid beneficiary who is a resident of Mississippi, unless all of the type of beds located in Mississippi that are needed to provide the services to the Medicaid beneficiary are filled or otherwise unavailable for use by the beneficiary.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
