House Bill 109
AN ACT TO AUTHORIZE MOTORCYCLES TO PROCEED AROUND STALLED TRAFFIC USING THE SHOULDER OF THE ROAD; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) A motorcycle may proceed around stalled traffic using the shoulder of the highway or road, if there is sufficient width to do so, provided that:
(a) The traffic must be traveling at a rate of speed less than thirty (30) miles per hour in the congested zone;
(b) The motorcycle cannot exceed ten (10) miles per hour greater than the speed of the stalled traffic;
(c) After completion of passing the stalled traffic, the motorcycle shall proceed in the normal marked lane.
(2) No driver or passenger of any motor vehicle shall impede a motorcycle proceeding under subsection (1) of this act.
SECTION 2. Section 1 of this act shall be codified as a new section in Chapter 3, Title 63, Mississippi Code of 1972.
SECTION 3. This act shall take effect and be in force from and after July 1, 2016.
