AN ACT TO CREATE SECTION 99-19-79, MISSISSIPPI CODE OF 1972, TO PROVIDE ENHANCE PENALTIES FOR SECOND OR SUBSEQUENT CRIMINAL OFFENSES FOR WHICH PENALTIES FOR SECOND OR SUBSEQUENT OFFENSES ARE NOT PROVIDED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 99-19-79, Mississippi Code of 1972:
99-19-79. (1) Every person who shall be convicted of committing a felony offense in violation of a criminal offense of which the person has previously been convicted and which statute provides for a maximum penalty less than death or life imprisonment may be imprisoned, in the discretion of the court, for a term of up to twice the term otherwise authorized, or both, regardless of the imprisonment and/or fine imposed for the previous conviction unless the statute setting the penalty for such violation provides some other penalty for a second or subsequent violation thereof.
(2) Nothing in this section shall be construed to limit in any manner the habitual sentencing provisions of Section 99-19-81 or Section 99-19-83.
SECTION 2. This act shall take effect and be in force from and after July 1, 2013.
