House Bill 1059

AN ACT TO ALLOW DISCOVERY BY A DEFENDANT IN A CRIMINAL CASE IN ANY CRIMINAL COURT IN THE STATE; TO ALLOW THE STATE THE SAME RIGHT IF A DEFENDANT REQUESTS DISCOVERY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Upon proper request a defendant in a criminal case in any criminal court in the state shall be entitled to discovery in the same manner as provided in Rule 9.04 of the Uniform Rules of Circuit and County Court Practice.  If a defendant requests discovery, the state shall likewise be entitled to discovery as provided in this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
