AMEND on line 555 after the period by inserting the following language:
The department shall provide written notice of intent to replace the executive director to the community mental health center's executive director and regional commission. The decision to replace the executive director with a contractor shall constitute an appealable action. The community mental health center's board of commissioners may submit a written request for appeal to the State Board of Mental Health within fourteen (14) days of receipt of the notice of intent. The State Board of Mental Health shall conduct a hearing within ninety (90) days of receipt of the request for appeal and shall issue a ruling within thirty (30) days of the hearing. Replacement shall occur only upon a final decision of the State Board of Mental Health after appeal. The department is responsible for contracting with the contractor and providing the funds to pay for the contractor. Any contractor selected by the department shall not expend community mental health center funds without approval of the community mental health center's board of commissioners and shall provide monthly progress reports to the board during the period of engagement.
FURTHER, AMEND the title to conform.
