AMENDMENT NO 1 TO COMMITTEE AMENDMENT NO 1 PROPOSED TO

 

House Bill No. 1069

     AMEND on lines 55 through 67 by striking paragraphs (a) and (b) in their entirety and inserting the following in lieu thereof:

     (8)  (a)  For a period of one (1) year following the effective date of this act, any person or entity proposing to construct a new wind-tower facility in this state shall submit a Waterfowl Impact Assessment to the Mississippi Department of Wildlife, Fisheries, and Parks for review and approval prior to commencing construction of such facility.

          (b)  The Waterfowl Impact Assessment shall evaluate potential impacts of the proposed wind-tower facility on migratory waterfowl, wildlife habitat, and related agricultural resources within the proposed project area and any recognized migratory corridors.

          (c)  The Mississippi Department of Wildlife, Fisheries, and Parks may request additional information from the project proponent as necessary to complete its review of the Waterfowl Impact Assessment.

          (d)  The Mississippi Department of Wildlife, Fisheries, and Parks shall establish reasonable procedures for the submission, review, and approval of Waterfowl Impact Assessments required under this subsection (8).

          (e)  No construction of a new wind-tower facility subject to this subsection (8) shall commence until the Mississippi Department of Wildlife, Fisheries, and Parks has approved the Waterfowl Impact Assessment.

          (f)  The provisions of this subsection (8) shall apply only to proposals for the construction of new wind-tower facilities initiated after the effective date of this act.
