JOINT RESOLUTION

Submitting to the qualified voters of Missouri an amendment repealing sections 2(a) and 2(b) of article IX of the Constitution of Missouri, and adopting two new sections in lieu thereof relating to the state board of education.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2014, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article IX of the Constitution of the state of Missouri:

            Section A. Sections 2(a) and 2(b), article IX, Constitution of Missouri, are repealed and two new sections adopted in lieu thereof, to be known as sections 2(a) and 2(b), to read as follows:

            Section 2(a). The supervision of instruction in the public schools shall be vested in a state board of education, consisting of eight [lay] members [appointed by the governor, by and with the advice and consent of the senate; provided, that at no time shall more than four members be of the same political party] elected in the general election in 2016, with one member elected from each of the state's congressional districts. The term of office of each member shall be eight years, except the terms of the first [appointees] members elected in 2016 shall be from one to eight years, respectively, with the member elected from the first congressional district to a term of one year, the member elected from the second congressional district to a term of two years, the member elected from the third congressional district to a term of three years, the member elected from the fourth congressional district to a term of four years, the member elected from the fifth congressional district to a term of five years, the member elected from the sixth congressional district to a term of six years, the member elected from the seventh congressional district to a term of seven years, and the member elected from the eighth congressional district to a term of eight years. Each member or successor shall then stand for office for a term of eight years. While attending to the duties of their office, members shall be entitled to receive only actual expenses incurred, and a per diem fixed by law.

            Section 2(b). The joint committee on education shall submit to the board a list of qualified nominees from which the board shall select and appoint a commissioner of education as its chief administrative officer, who shall be a citizen and resident of the state, and removable at its discretion. The board shall prescribe his or her duties and fix his or her compensation, and upon [his] the commissioner's recommendation shall appoint the professional staff and fix their compensation. The board shall succeed the state board of education heretofore established, with all its powers and duties, and shall have such other powers and duties as may be prescribed by law.
