AN ACT

To amend chapter 355, RSMo, by adding thereto one new section relating to nonprofit corporations.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 355, RSMo, is amended by adding thereto one new section, to be known as section 355.429, to read as follows:

            355.429. 1. Any entity organized under this chapter, or foreign corporation registered with the secretary of state, which solicits contributions or gifts from the public shall, upon request, provide the name and compensation amount of any board member or officer of the corporation that is paid any amount for any reason by the corporation.

            2. The request for information regarding any board member's or officer's compensation under subsection 1 of this section shall be in writing by certified mail. Such request shall specify a time period for which compensation was paid. If no time period is specified, only the current fiscal year-to-date information shall be provided.

            3. The corporation has ten days from receipt of the request to respond in writing to the requester.

            4. If the entity has members, this section shall not apply to nonprofit corporations that solicit contributions or gifts solely from its own existing members.
