AN ACT

To amend chapter 436, RSMo, by adding thereto one new section relating to broadcasting of professional sporting events in publicly funded stadiums.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 436, RSMo, is amended by adding thereto one new section, to be known as section 436.175, to read as follows:

            436.175. 1. If the broadcast of any home sporting event of a professional sports team or franchise whose home stadium is located in this state is blacked out for any reason, including under the blackout rules of the professional league to which such team or franchise is a member, the professional sports team or franchise shall be ineligible to receive any public funds from the state of Missouri in the next state fiscal year.

            2. The provisions of this section shall not apply to:

            (1) Any public funds already appropriated prior to the effective date of this section;

            (2) Any revenues from taxes to support a sports franchise, stadium, or sports complex if such tax levy is in effect on the effective date of this section; and

            (3) Any public funds appropriated or allocated which would constitute a breach of contract if such funds were not distributed in accordance with such contract.
