AN ACT

To amend chapter 577, RSMo, by adding thereto one new section relating to the crime of practicing medicine while intoxicated, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 577, RSMo, is amended by adding thereto one new section, to be known as section 577.650, to read as follows:

            577.650. 1. A physician or other licensed health care professional commits the crime of practicing medicine while intoxicated if he or she performs a surgical or medical procedure upon a patient while in an intoxicated condition, as defined in section 577.001.

            2. The crime of practicing medicine while intoxicated is a class B misdemeanor. Any second or subsequent violation of this section is a class A misdemeanor. If a violation of this section results in physical injury to a patient, the violation is a class C felony. Any second or subsequent violation resulting in physical injury to a patient is a class B felony.
