AN ACT

To amend chapter 290, RSMo, by adding thereto one new section relating to use of credit scores by prospective employers.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 290, RSMo, is amended by adding thereto one new section, to be known as section 290.146, to read as follows:

            290.146. 1. Except as provided in subsection 2 of this section, it shall be an improper employment practice for any employer to directly or indirectly use a job applicant's personal credit history as hiring criteria.

            2. An employer may request a credit history background check as part of the application process where such history is shown to be directly related to the occupational position sought by the job applicant. Such history shall not be the determinant factor in whether the job applicant is ultimately hired to the position sought.
