AN ACT

To amend chapter 115, RSMo, by adding thereto one new section relating to electronic precinct registers.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 115, RSMo, is amended by adding thereto one new section, to be known as section 115.164, to read as follows:

            115.164. 1. Each election authority shall compile and use an interactive computerized voter registration list for voters who have no form of personal identification containing a photograph of the voter that is issued by the state. The system shall be maintained and administered by the secretary of state, shall contain the same voter registration information required under section 115.157, and shall be able to store and display a photograph of any voter who has no such state-issued form of personal identification with a photograph. Any such list shall comply with all requirements of other voter registration lists as required by this chapter, and shall be subject to the same procedures for use, disclosure, and verification of such lists as required by this chapter.

            2. The secretary of state shall provide funding to each election authority to create a voter registration list as provided in this section from an appropriation made for such purpose. If no appropriation is made for such purpose, no election authority shall be required to create or use the voter registration list provided for in this section.

            3. No voter shall be required to enter the voter's registration information and photograph into the registration list created in this section, but the election authority shall inform such voters that entering the voter's registration information and photograph in such registration list may decrease the amount of time spent in identifying the voter. Any voter who declines to enter the voter's registration information and photograph into such registration list shall be allowed to vote as other voters with no state-issued form of personal identification with a photograph are allowed to vote under this chapter.

            4. An election authority may establish a separate line in each polling place for voters wishing to enter their voter registration information and photograph into such registration list in addition to all other polling place requirements provided in this chapter.

            5. The secretary of state may promulgate rules to implement the provisions of this section. Any rule or portion of a rule, as that term is defined in section 536.010, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable and if any of the powers vested with the general assembly under chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2013, shall be invalid and void.
