AN ACT

To amend chapter 324, RSMo, by adding thereto one new section relating to disciplinary actions against licensed professionals.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 324, RSMo, is amended by adding thereto one new section, to be known as section 324.045, to read as follows:

            324.045. 1. Notwithstanding other provisions of chapter 324 and the specific statutory authority afforded the boards of the division of professional registration, the division or the board shall initiate a hearing before the division or board for discipline of any licensee's license or certificate upon receipt of certified court records of a full and final adjudication of a finding of guilt or plea of guilty to any of the following offenses established under Missouri law or offenses of a similar nature established under the laws of any other state or of the United States and its territories, or any other country, whether or not the sentence is imposed:

            (1) Any dangerous felony as defined in section 556.061 or murder in the first degree;

            (2) Any of the following sexual offenses:

            (a) Rape;

            (b) Statutory rape in the first degree;

            (c) Statutory rape in the second degree;

            (d) Sexual assault;

            (e) Forcible sodomy;

            (f) Statutory sodomy in the first degree;

            (g) Statutory sodomy in the second degree;

            (h) Child molestation in the first degree;

            (i) Child molestation in the second degree;

            (j) Deviate sexual assault;

            (k) Sexual misconduct in the first degree;

            (l) Sexual abuse;

            (m) Enticement of a child;

            (n) Attempting to entice a child;

            (3) Any of the following offenses against the family and related offenses:

            (a) Incest;

            (b) Abandonment of a child in the first degree;

            (c) Abandonment of a child in the second degree;

            (d) Endangering the welfare of a child in the first degree;

            (e) Abuse of a child;

            (f) Child used in a sexual performance;

            (g) Promoting sexual performance by a child;

            (h) Trafficking in children;

            (4) Any of the following offenses involving child pornography and related offenses:

            (a) Promoting obscenity in the first degree;

            (b) Promoting obscenity in the second degree when the penalty is enhanced to a class D felony;

            (c) Promoting child pornography in the first degree;

            (d) Promoting child pornography in the second degree;

            (e) Possession of child pornography in the first degree;

            (f) Possession of child pornography in the second degree;

            (g) Furnishing child pornography to a minor;

            (h) Furnishing pornographic materials to minors;

            (i) Coercing acceptance of obscene materials; or

            (5) Any of the following offenses involving fraud and/or forgery:

            (a) Forgery;

            (b) Possession of a forging instrumentality;

            (c) Counterfeiting;

            (d) Issuing a false instrument or certificate;

            (e) Passing bad checks;

            (f) Fraudulently stopping payment on an instrument;

            (g) Fraudulent use of a credit device or debit device;

            (h) Fraudulent procurement of a credit or debit card;

            (i) Deceptive business practice;

            (j) Financial exploitation of the elderly and disabled;

            (k) Commercial bribery.

            2. The division shall provide the licensee not less than thirty days' notice of any hearing held under this section. The division shall also inform the licensee of his or her right to be represented by counsel at any hearing held under this section.

            3. The division's decision regarding discipline of a license shall be subject to judicial review under chapter 536.
