AN ACT

To amend chapter 21, RSMo, by adding thereto one new section relating to vacancies in the general assembly.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 21, RSMo, is amended by adding thereto one new section, to be known as section 21.135, to read as follows:

            21.135. Notwithstanding any other provision of law to the contrary, in any election to fill a vacancy for either state representative or state senator, if the number of candidates who have filed for the vacant office, including candidates who have filed a declaration of intent to be a write-in candidate under chapter 115, is equal to the number of vacant positions for such office to be filled by the election and if the only questions to be voted on in the election are questions involving filling the unexpired term of a state representative or state senator, no election shall be held for such office, and the candidate shall assume the responsibilities of the office at the same time and in the same manner as if the candidate had been elected.
