AN ACT

To amend chapter 302, RSMo, by adding thereto one new section relating to an emergency contact database, with an effective date.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 302, RSMo, is amended by adding thereto one new section, to be known as section 302.790, to read as follows: 

            302.790. The department of revenue may create an emergency contact database for instruction permit, driver's license, and nondriver's license holders to enter the names, addresses, and telephone and cellular telephone numbers for no more than two emergency contact persons they wish to be contacted if involved in a motor vehicle accident or other emergency situation when the person is unable to communicate. Applicants and permit and license holders shall be allowed to provide the emergency contact information to the license clerk when completing his or her permit, driver's or nondriver's license transaction, or the department may make available an online application to allow the updates. All information contained in the database shall be made available to law enforcement and other emergency personnel if requested provided they have online access to the driver record, or law enforcement may share the information contained in the database when necessary with other law enforcement or emergency personnel. The department of revenue, law enforcement, and other emergency personnel shall not incur liability for sharing any emergency contact information with other law enforcement or emergency personnel, or if the applicant fails to keep the emergency contact information updated.

            Section B. The enactment of section 302.790 of Section A of this act shall become effective on July 1, 2013, or on the date the director of the department of revenue begins accepting emergency contact information, whichever occurs first. If the director of revenue begins accepting emergency contact information prior to July 1, 2013, the director shall notify the revisor of statutes of such fact.
