AN ACT
To amend chapter 193, RSMo, by adding thereto one new section relating to heritage birth certificates and heritage marriage certificates.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 193, RSMo, is amended by adding thereto one new section, to be known as section 193.259, to read as follows:
193.259. 1. The state of Missouri may promote and sell a "Heritage Birth Certificate" and a "Heritage Marriage Certificate". In addition to any other birth or marriage certificates issued under this chapter, the state registrar may issue, upon request, a heritage birth or marriage certificate representing the birth or marriage of the individual named on the original record or certificate. The state registrar may establish procedures for the administration of a heritage birth or marriage certificate. Each copy issued shall contain the date of registration, and copies issued from records marked "Delayed" or "Amended" shall be similarly marked and contain the effective date. The documentary evidence used to establish a delayed certificate shall be shown on all copies issued.
2. A heritage birth or marriage certificate issued shall be in a form consistent with the need to protect the integrity of vital records, including securing measures designed to prevent tampering, counterfeiting, or otherwise duplicating the birth or marriage certificate for fraudulent purposes, in accordance with the Federal Intelligence Reform and Terrorism Prevention Act of 2004, as amended. The certificate shall be suitable for display. Such certificate may bear the seal of the state of Missouri and may be signed by the governor.
3. The heritage birth or marriage certificate shall have the same status as evidence as an original or certified birth or marriage certificate, as described in section 193.255. Heritage birth or marriage certificates shall only be issued to individuals born or married in Missouri.
4. Upon request and issuance of a heritage birth or marriage certificate, the department of health and senior services may charge a fee of fifty dollars. The fifty dollar fee shall be deposited in the state treasury as follows:
(1) Four dollars to the general revenue fund;
(2) Ten dollars to the children's trust fund established in section 210.173. Fee moneys deposited in such fund shall, upon appropriation, be used to support children in the special health care needs program;
(3) One dollar to the endowed care cemetery audit fund. Fee moneys deposited in such fund shall be available for appropriation to the division of professional registration to pay expenses incurred in the administration of sections 214.270 to 214.410;
(4) Fifteen dollars to the crippled children's services fund established in section 201.090; and
(5) Twenty dollars to the Missouri public health services fund established in section 192.900. Fee moneys designated for such fund shall be deposited in a separate subaccount and upon appropriation, shall be used to support the collection, maintenance, analysis, and issuance of vital records, including heritage birth and marriage certificates.
