AN ACT
To amend chapter 407, RSMo, by adding thereto one new section relating to insurance companies owning or contracting with motor vehicle body repair shops, with penalty provisions.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.297, to read as follows:
407.297. No insurer, as defined in section 407.295, shall:
(1) Acquire any ownership interest in an auto body repair shop. An insurer that has an ownership interest in an auto body repair shop shall divest itself of such interest by August 28, 2013;
(2) Offer an incentive or compensation to any person for referring an insured to a specific auto body repair shop.
Any violation of this section is an unlawful practice as the term is used in sections 407.010 to 407.130, and shall be subject to the enforcement provisions of sections 407.010 to 407.130.
