AN ACT

To amend chapter 550, RSMo, by adding thereto one new section relating to circuit court fees.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 550, RSMo, is amended by adding thereto one new section, to be known as section 550.245, to read as follows:

            550.245. 1. Each circuit court clerk shall charge and collect an electronic citation fee of five dollars in order to assist in paying for costs association with establishing and maintaining electronic citations. Such fee shall be paid by the defendant in any traffic, misdemeanor, municipal ordinance, conservation, or other citations issued upon a plea of guilty, judgment of guilty, or grant of supervision. This fee shall be in addition to all other fees authorized by law and assessable as costs.

            2. Sixty percent of the fees collected under subsection 1 of this section shall be deposited into the circuit court clerk electronic citation fund created by this section. Forty percent of the fees shall be disbursed to the arresting agency to reimburse for expenses related to the establishment and maintenance of electronic citations.

            3. There is hereby created in the state treasury a revolving fund to be administered by the department of public safety to be known as the “Circuit Court Clerk Electronic Citation Fund”. The fund shall consist of sixty percent of moneys collected from fees authorized by this section and shall be used to perform the duties required by county circuit court clerk offices for establishing and maintaining electronic citations.

            4. The county circuit clerk shall not charge and collect an electronic citation fee in the event the county commission elects to be exempt from the provisions of this section.

            5. For the purposes of this section, “electronic citation” shall mean the process of transmitting traffic, misdemeanor, municipal ordinance, conservation, or other citations and law enforcement data via electronic means to a circuit court clerk.
