AN ACT

To amend chapter 565, RSMo, by adding thereto one new section relating to the crime of drug-induced murder, with penalty provisions.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.018, to read as follows:

            565.018. 1. A person commits the crime of drug-induced murder if such person violates the provisions of section 195.211 or 195.222 by unlawfully delivering a controlled substance to another when any person's death is caused by the injection, inhalation, absorption, or ingestion of any amount of that controlled substance.

            2. Drug-induced murder when the controlled substance delivered is any substance other than methamphetamine is a felony for which the punishment is imprisonment for a term of years not less than fifteen years and not more than thirty years. This punishment shall be consecutive to any punishment imposed for the underlying violation of section 195.211 or 195.222.

            3. Drug-induced murder when the controlled substance delivered is methamphetamine is a felony for which the punishment is imprisonment for a term of years not less than thirty years and not more than sixty years. This punishment shall be consecutive to any punishment imposed for the underlying violation of section 195.211 or 195.222.
