1.2relating to energy; removing ban on increased carbon dioxide emissions by
1.3utilities; amending Minnesota Statutes 2010, section 216H.02, subdivision 4;
1.4repealing Minnesota Statutes 2010, section 216H.03.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 216H.02, subdivision 4, is amended to
1.7read:
1.8 Subd. 4. General elements of the plan. The plan must:
1.9 (1) estimate 1990 and 2005 greenhouse gas emissions in the state and make
1.10projections of emissions in 2015, 2025, and 2050;
1.11 (2) identify, evaluate, and integrate a broad range of statewide greenhouse gas
1.12reduction options for all emission sectors in the state;
1.13 (3) assess the costs, benefits, and feasibility of implementing the options;
1.14 (4) recommend an integrated set of reduction options and strategies for implementing
1.15the options that will achieve the goals in subdivision 1, including analysis of the associated
1.16costs and benefits to Minnesotans;
1.17 (5) estimate the statewide greenhouse gas emissions reductions anticipated from
1.18implementation of existing state policies; and
1.19 (6) recommend a system to require the reporting of statewide greenhouse gas
1.20emissions, identifying which facilities must report, and how emission estimates should
1.21be made; and.
1.22(7) evaluate the option of exempting a project from the prohibitions contained in
1.23section
216H.03, subdivision 3, if the project contributes a specified fee per ton of carbon
1.24dioxide emissions emitted annually by the project, the proceeds of which would be used to
2.1fund permanent, quantifiable, verifiable, and enforceable reductions in greenhouse gas
2.2emissions that would not otherwise have occurred.
2.3 Sec. 2. REPEALER.
2.4Minnesota Statutes 2010, section 216H.03, is repealed.
