1.2relating to higher education; providing for the use of student data;proposing
1.3coding for new law in Minnesota Statutes, chapter 136A.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [136A.051] STUDENT RECORDS AND DATA.
1.6When any institution of higher education provides the Office of Higher Education,
1.7Department of Education, or any other state agency student data or records, the institution
1.8of higher education shall not be liable for any breach of confidentiality, disclosure, use,
1.9retention, or destruction of such student data or records, if the breach, disclosure, use,
1.10retention, or destruction of the records resulted from actions or omissions of:
1.11(1) the Office of Higher Education, Department of Education, or any other state
1.12agency; or
1.13(2) individuals or entities provided access to the education records by the Office of
1.14Higher Education, the Department of Education, or any other state agency.
