1.1A bill for an act
1.2relating to local government; changing the city of St. Paul dedication fee.
1.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.4    Section 1. CITY OF ST. PAUL DEDICATION FEE.
1.5The city of St. Paul may require that a reasonable portion of land be dedicated to the
1.6public or impose a dedication fee in conjunction with the construction permit required for
1.7new housing units and new commercial and industrial development in the city, wherever
1.8located, for public parks, playgrounds, recreational facilities, wetlands, trails, or open
1.9space. The dedication of land or dedication fee must be imposed by an ordinance enacted
1.10by the city council. The cash fee may be set at a flat fee rate per net new residential
1.11unit. The ordinance may exclude senior housing and affordable housing from paying the
1.12fee or the dedication of land. The provisions of Minnesota Statutes, section 462.358,
1.13subdivisions 2b, paragraph (b), and 2c, apply to the application and use of the dedication
1.14of land or the dedication fee.
1.15EFFECTIVE DATE.This section is effective the day following final enactment
1.16and applies to dedication fee ordinances adopted or amended by the city of St. Paul
1.17before, on, or after that date.
