1.2relating to crime victims; authorizing a victim's estate to request or enforce an
1.3order for restitution;amending Minnesota Statutes 2012, section 611A.04, by
1.4adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 611A.04, is amended by adding a
1.7subdivision to read:
1.8 Subd. 6. Estate of victim. If a victim dies before or after a request for restitution is
1.9made or an order for restitution is issued, the personal representative of the victim's estate
1.10may request or enforce an order for restitution on behalf of the victim. If a personal
1.11representative is not appointed and no application is pending, an heir of the victim may
1.12file an affidavit to request or enforce an order for restitution pursuant to this subdivision.
1.13Appointment of a personal representative does not affect the right of other victims, as
1.14defined in section 611A.01, to request an order for restitution on their behalf.
1.15EFFECTIVE DATE.This section is effective the day following final enactment.
