1.1A bill for an act
1.2relating to education; requiring a waiver application from No Child Left Behind;
1.3modifying enforcement of education statutes.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. NO CHILD LEFT BEHIND ACT; WAIVER FROM FINANCIAL
1.6CONSTRAINTS.
1.7(a) The commissioner of education must immediately petition the federal
1.8Department of Education to allow Minnesota schools to continue to receive federal
1.9funds under the No Child Left Behind Act of 2001 for state educational services without
1.10the restrictions in federal regulations. The commissioner must include in the petition
1.11information to demonstrate the long history of Minnesota's educational efficacy and how
1.12flexibility related to expending such federal funds will enhance the state education system.
1.13(b) The commissioner must not enforce the educational assessment and
1.14accountability provisions in Minnesota Statutes, chapter 120B, related to implementing
1.15the No Child Left Behind Act of 2001 after the 2012-2013 school year. A school board
1.16may file a written resolution with the state auditor under Minnesota Statutes, section
1.176.79, recommending how the legislature should reform the educational assessment
1.18and accountability provisions in Minnesota Statutes, chapter 120B, absent the federal
1.19mandates. The commissioner may report proposals and requests to the educational
1.20committees of the legislature by January 1, 2013.
