1.2A bill for an act
1.3relating to health occupations; providing for a Nurse Licensure Compact;
1.4providing for appointments; appropriating money;proposing coding for new
1.5law in Minnesota Statutes, chapter 148.

1.11We, the undersigned conferees for S.F. No. 230 report that we have agreed upon the
1.12items in dispute and recommend as follows:
1.13That the House recede from its amendments and that S.F. No. 230 be further
1.14amended as follows:
1.15Page 10, after line 33, insert:

1.16    "Sec. 6. NURSE LICENSURE COMPACT STUDY.
1.17(a) The commissioner of health shall, in consultation with the Office of Rural Health
1.18and Primary Care, nurse contract bargaining units, the Board of Nursing, professional
1.19nurse organizations, long-term care associations, hospitals and health systems, and the
1.20Nurse Licensure Compact administrators, study and prepare a report for the governor on
1.21the impact of adoption of the Nurse Licensure Compact in Minnesota on the following
1.22areas:
1.23(1) access to care, including but not limited to, access to telemedicine, e-medicine,
1.24and medical homes;
1.25(2) the estimated number of nurses currently licensed in other compact states who
1.26are projected to practice in Minnesota and the number currently licensed in Minnesota
1.27who are projected to practice in other compact states and the potential impact to the
1.28Board of Nursing licensure fee revenues and to individual nurses if the nurse licensure
1.29compact is adopted;
2.1(3) the impact on regulatory oversight of nurses in terms of disciplinary actions;
2.2(4) the impact on labor relations in states that have adopted the nurse licensure
2.3compact, to the extent this impact can be determined;
2.4(5) reducing duplication of nurse licensure; and
2.5(6) the variations in qualifications, scope of practice, licensure standards, and
2.6licensure fees between Minnesota and neighboring states that are members of the compact.
2.7(b) The commissioner shall present the report in paragraph (a) to the governor no
2.8later than September 30, 2013, and the governor shall consider the findings of this report
2.9in determining whether to implement the Nurse Licensure Compact."
2.10Page 11, line 2, before "$149,000" insert "(a)"
2.11Page 11, after line 4, insert:
2.12"(b) $120,000 in fiscal year 2013 is appropriated from the state government special
2.13revenue fund to the Board of Nursing to transfer to the commissioner of health for the
2.14Nurse Licensure Compact study. This is a onetime appropriation."
2.15Page 11, delete section 7 and insert:

2.16    "Sec. 8. EFFECTIVE DATE.
2.17(a) In order for sections 1 to 5 to be effective, the governor must issue an
2.18executive order directing the executive director of the state Board of Nursing to begin
2.19implementation of the Nurse Licensure Compact.
2.20(b) If the governor issues an executive order under paragraph (a), then sections 1
2.21to 5 are effective upon implementation of the coordinated licensure information system
2.22in section 1, article 6. Section 7, paragraph (a), is effective the day after the governor
2.23issues the executive order.
2.24(c) If the governor does not issue the executive order under paragraph (a) by
2.25December 31, 2013, sections 1 to 5, and section 7, paragraph (a), do not become effective
2.26and do not have the force of law.
2.27(d) Sections 6 and 7, paragraph (b), are effective the day following final enactment."
2.28Renumber the sections in sequence and correct the internal references
2.29Amend the title as follows:
2.30Page 1, line 2, after the second semicolon, insert "providing for implementation by
2.31executive order; requiring a study;"
