1.2relating to public safety; providing for the registration of automatic external
1.3defibrillators;proposing coding for new law in Minnesota Statutes, chapter 403.1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [403.51] AUTOMATIC EXTERNAL DEFIBRILLATION;
1.6REGISTRATION.
1.7    Subdivision 1. Definitions. (a) For purposes of this section, the following terms
1.8have the meanings given them.
1.9(b) "Automatic external defibrillator" or "AED" means an electronic device designed
1.10and manufactured to operate automatically or semiautomatically for the purpose of
1.11delivering an electrical current to the heart of a person in sudden cardiac arrest.
1.12(c) "AED registry" means a registry of AEDs that requires a maintenance program
1.13or package, and includes, but is not limited to: the Minnesota AED Registry, the National
1.14AED Registry, iRescU, or a manufacturer-specific program.
1.15(d) "Public Access AED" means an AED that is intended, by its markings or display,
1.16to be used or accessed by the public for the benefit of the general public that may be in the
1.17vicinity or location of that AED. It does not include an AED that is owned or used by a
1.18hospital, clinic, business, or organization that is intended to be used by staff and is not
1.19marked or displayed in a manner to encourage public access.
1.20(e) "Maintenance program or package" means a program that will alert the AED
1.21owner when the AED has electrodes and batteries due to expire or replaces those expiring
1.22electrodes and batteries for the AED owner.
1.23(f) "Public safety agency" means local law enforcement, county sheriff, municipal
1.24police, tribal agencies, state law enforcement, fire departments, including municipal
2.1departments, industrial fire brigades, and nonprofit fire departments, joint powers agencies,
2.2and licensed ambulance services.
2.3(g) "Mobile AED" means an AED that (1) is purchased with the intent of being located
2.4in a vehicle, including, but not limited to, public safety agency vehicles; or (2) will not be
2.5placed in stationary storage, including, but not limited to, an AED used at an athletic event.
2.6(h) "Private Use AED" means an AED that is not intended to be used or accessed by
2.7the public for the benefit of the general public. This may include, but is not limited to,
2.8AEDs found in private residences.
2.9    Subd. 2. Registration. A person who purchases or obtains a Public Access AED
2.10shall register that device with an AED registry within 30 working days of receiving the
2.11AED.
2.12    Subd. 3. Required information. A person registering a Public Access AED shall
2.13provide the following information for each AED:
2.14(1) AED manufacturer, model, and serial number;
2.15(2) specific location where the AED will be kept; and
2.16(3) the title, address, and telephone number of a person in management at the
2.17business or organization where the AED is located.
2.18    Subd. 4. Information changes. The owner of a Public Access AED shall notify the
2.19owner's AED registry of any changes in the information that is required in the registration
2.20within 30 working days of the change occurring.
2.21    Subd. 5. Public Access AED requirements. A Public Access AED:
2.22(1) may be inspected during regular business hours by a public safety agency with
2.23jurisdiction over the location of the AED;
2.24(2) must be kept in the location specified in the registration; and
2.25(3) must be reasonably maintained, including replacement of dead batteries and
2.26pads/electrodes, and comply with all manufacturer's recall and safety notices.
2.27    Subd. 6. Removal of AED. An authorized agent of a public safety agency with
2.28jurisdiction over the location of the AED may direct the owner of a Public Access AED to
2.29comply with this section. The authorized agent of the public safety agency may direct
2.30the owner of the AED to remove the AED from its public access location and to remove
2.31or cover any public signs relating to that AED if it is determined that the AED is not
2.32ready for immediate use.
2.33    Subd. 7. Private Use AEDs. The owner of a Private Use AED is not subject to the
2.34requirements of this section but is encouraged to maintain the AED in a consistent manner.
2.35    Subd. 8. Mobile AEDs. The owner of a Mobile AED is not subject to the
2.36requirements of this section but is encouraged to maintain the AED in a consistent manner.
3.1    Subd. 9. Signs. A person acquiring a Public Use AED is encouraged but is not
3.2required to post signs bearing the universal AED symbol in order to increase the ease of
3.3access by the public to the AED in the event of an emergency. A person may not post any
3.4AED sign or allow any AED sign to remain posted upon being ordered to remove or cover
3.5any AED signs by an authorized agent of a public safety agency.
3.6    Subd. 10. Emergency response plans. The owner of one or more Public Access
3.7AEDs shall develop an emergency response plan appropriate for the nature of the facility
3.8the AED is intended to serve.
3.9    Subd. 11. Civil or criminal liability. This section does not create any civil liability
3.10on the part of an AED owner or preclude civil liability under other law. Section 645.241
3.11does not apply to this section.
3.12EFFECTIVE DATE.This section is effective August 1, 2014.
