1.1A bill for an act
1.2relating to environment; modifying the definition of solid waste to exempt certain
1.3highway construction, improvement, or repair activities;amending Minnesota
1.4Statutes 2010, section 116.06, subdivision 22.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 116.06, subdivision 22, is amended to read:
1.7    Subd. 22. Solid waste. "Solid waste" means garbage, refuse, sludge from a water
1.8supply treatment plant or air contaminant treatment facility, and other discarded waste
1.9materials and sludges, in solid, semisolid, liquid, or contained gaseous form, resulting
1.10from industrial, commercial, mining, and agricultural operations, and from community
1.11activities, but does not include hazardous waste; animal waste used as fertilizer; earthen
1.12fill, boulders, rock; concrete diamond grinding and saw slurry associated with the
1.13construction, improvement, or repair of a road when deposited on the road project site in a
1.14manner that is in compliance with best management practices and rules of the agency;
1.15sewage sludge; solid or dissolved material in domestic sewage or other common pollutants
1.16in water resources, such as silt, dissolved or suspended solids in industrial wastewater
1.17effluents or discharges which are point sources subject to permits under section 402 of
1.18the Federal Water Pollution Control Act, as amended, dissolved materials in irrigation
1.19return flows; or source, special nuclear, or by-product material as defined by the Atomic
1.20Energy Act of 1954, as amended.
