1.1A bill for an act
1.2relating to education; making students' economic circumstances a criterion for
1.3arranging competitive interscholastic conferences and determining competitive
1.4classifications;amending Minnesota Statutes 2012, sections 128C.02,
1.5subdivision 3; 128C.05, subdivision 2.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2012, section 128C.02, subdivision 3, is amended to read:
1.8    Subd. 3. Criteria for conference arrangements. (a) To arrange competitive
1.9interscholastic conferences, the board must consider, in addition to the criteria under
1.10paragraph (b), students' economic circumstances including the number and percentage of
1.11students eligible to receive a free or reduced-price lunch in the school and district, the
1.12per capita income of persons residing in the district, the amount of the referendum levy
1.13in the district, and the district referendum market value.
1.14(b) Consistent with paragraph (a), the board must develop criteria for the league to
1.15use when it is asked to arrange for membership in an interscholastic conference by a
1.16league member under section 128C.07. The league must give notice and an opportunity
1.17for league members to be heard before adopting the criteria. The criteria must include,
1.18at least, the distance to be traveled by competing schools, the relative enrollments of the
1.19schools, and the comparability of extracurricular activities in the schools.
1.20EFFECTIVE DATE.This section is effective the day following final enactment.

1.21    Sec. 2. Minnesota Statutes 2012, section 128C.05, subdivision 2, is amended to read:
1.22    Subd. 2. Classes. The league shall determine the number of competitive classes
1.23in all interscholastic athletic activities under its jurisdiction based on students' economic
2.1circumstances including the number and percentage of students eligible to receive a free or
2.2reduced-price lunch in the school and district, the per capita income of persons residing in
2.3the district, the amount of the referendum levy in the district, and the district referendum
2.4market value, among other relevant criteria.
2.5EFFECTIVE DATE.This section is effective the day following final enactment.
