1.1A bill for an act
1.2relating to crime; extending the felony of fraudulent or other improper financing
1.3statements to include retaliation against a police officer, chief of police, or official
1.4or employee of the Department of Corrections or local correctional agency for
1.5performing official duties;amending Minnesota Statutes 2012, section 609.7475,
1.6subdivision 3.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2012, section 609.7475, subdivision 3, is amended to read:
1.9    Subd. 3. Penalties. (a) Except as provided in paragraph (b), a person who violates
1.10subdivision 2 is guilty of a gross misdemeanor.
1.11(b) A person who violates subdivision 2 is guilty of a felony and may be sentenced
1.12to imprisonment for not more than five years or to payment of a fine of not more than
1.13$10,000, or both, if the person:
1.14(1) commits the offense with intent to influence or otherwise tamper with a juror
1.15or a judicial proceeding or with intent to retaliate against:
1.16(i) a judicial officer, as defined in section 609.415;
1.17(ii) a prosecutor, defense attorney, or officer of the court, because of that person's
1.18performance of official duties in connection with a judicial proceeding;
1.19(iii) a sheriff or deputy sheriff because of that person's performance of official duties
1.20in connection with a sheriff's sale of real property; or
1.21(iv) a police officer or chief of police because of that person's performance of
1.22official duties;
1.23(v) an official or employee of the Department of Corrections or a local correctional
1.24agency because of that person's performance of official duties; or
2.1(iv) (vi) a county recorder because of that person's performance of official duties in
2.2connection with the filing of liens placed on real property; or
2.3(2) commits the offense after having been previously convicted of a violation
2.4of this section.
2.5EFFECTIVE DATE.This section is effective August 1, 2014, and applies to crimes
2.6committed on or after that date.
