1.1A bill for an act
1.2relating to economic development; requiring state agencies to establish youth
1.3internships or apprenticeships; encouraging utilization of small businesses in
1.4state procurement; promoting ethnic and cultural heritage tourism;amending
1.5Minnesota Statutes 2012, sections 16C.18, by adding a subdivision; 16C.20;
1.6124D.47, subdivision 2; 129D.17, subdivision 2.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2012, section 16C.18, is amended by adding a
1.9subdivision to read:
1.10    Subd. 4. Small business utilization in state procurement. All state agencies
1.11including MnSCU shall, and the University of Minnesota is requested to, submit an annual
1.12performance report to the commissioner of administration regarding small and targeted
1.13business utilization and measures taken to improve utilization of these businesses in state
1.14procurement. The commissioner of administration shall submit a summary of the reports
1.15to the legislature annually on January 15.

1.16    Sec. 2. Minnesota Statutes 2012, section 16C.20, is amended to read:
1.1716C.20 CERTIFICATION.
1.18(a) A business that is certified by the commissioner of administration as a small
1.19business, small targeted group business, a small business located in an economically
1.20disadvantaged area, or a veteran-owned small business is eligible to participate under the
1.21requirements of sections 137.31 and 161.321 and, if certified as a small business, small
1.22targeted group business, or veteran-owned small business, under section 473.142 without
1.23further certification by the contracting agency.
2.1(b) A business that meets the requirements of paragraph (a) is not required to undergo
2.2further certification for the same status by any state or local government entity in Minnesota.

2.3    Sec. 3. Minnesota Statutes 2012, section 124D.47, subdivision 2, is amended to read:
2.4    Subd. 2. Youth apprenticeship programs. (a) A comprehensive youth
2.5apprenticeship program must require representatives of secondary and postsecondary
2.6school systems, affected local businesses, industries, occupations and labor, as well as the
2.7local community, to be actively and collaboratively involved in advising and managing the
2.8program and ensuring, in consultation with local private industry councils, that the youth
2.9apprenticeship program meets local labor market demands, provides student apprentices
2.10with the high skill training necessary for career advancement, meets applicable state
2.11graduation requirements and labor standards, pays apprentices for their work and provides
2.12support services to program participants.
2.13(b) Local employers, collaborating with labor organizations where appropriate,
2.14must assist the program by analyzing workplace needs, creating work-related curriculum,
2.15employing and adequately paying youth apprentices engaged in work-related learning in
2.16the workplace, training youth apprentices to become skilled in an occupation, providing
2.17student apprentices with a workplace mentor, periodically informing the school of an
2.18apprentice's progress, and making a reasonable effort to employ youth apprentices who
2.19successfully complete the program.
2.20(c) A student participating in a comprehensive youth apprenticeship program
2.21must sign a youth apprenticeship agreement with participating entities that obligates
2.22youth apprentices, their parents or guardians, employers, and schools to meet program
2.23requirements; indicates how academic instruction, work-based learning, and worksite
2.24learning and experience will be integrated; ensures that successful youth apprentices will
2.25receive a recognized credential of academic and occupational proficiency; and establishes
2.26the wage rate and other benefits for which youth apprentices are eligible while employed
2.27during the program.
2.28(d) Secondary school principals, counselors, or business mentors familiar with
2.29the education to employment transitions system must inform entering secondary school
2.30students about available occupational and career opportunities and the option of entering
2.31a youth apprenticeship or other work-based learning program to obtain postsecondary
2.32academic and occupational credentials.
2.33(e) All state agencies shall be required to establish youth internship or apprenticeship
2.34programs, with an emphasis on youth with disabilities or targeted youth who are at risk
2.35or economically disadvantaged.
3.1(f) All public contracts over $100,000,000 shall include a youth internship or
3.2apprenticeship component for youth, with an emphasis on youth with disabilities or
3.3targeted youth who are at risk or economically disadvantaged.

3.4    Sec. 4. Minnesota Statutes 2012, section 129D.17, subdivision 2, is amended to read:
3.5    Subd. 2. Expenditures; accountability. (a) Funding from the arts and cultural
3.6heritage fund may be spent only for arts, arts education, and arts access, and to preserve
3.7Minnesota's history and cultural heritage, and promote and develop ethnic and cultural
3.8heritage tourism. A project or program receiving funding from the arts and cultural heritage
3.9fund must include measurable outcomes, and a plan for measuring and evaluating the
3.10results. A project or program must be consistent with current scholarship, or best practices,
3.11when appropriate and must incorporate state-of-the-art technology when appropriate.
3.12(b) Funding from the arts and cultural heritage fund may be granted for an entire
3.13project or for part of a project so long as the recipient provides a description and cost for
3.14the entire project and can demonstrate that it has adequate resources to ensure that the
3.15entire project will be completed.
3.16(c) Money from the arts and cultural heritage fund shall be expended for benefits
3.17across all regions and residents of the state.
3.18(d) A state agency or other recipient of a direct appropriation from the arts and
3.19cultural heritage fund must compile and submit all information for funded projects or
3.20programs, including the proposed measurable outcomes and all other items required
3.21under section 3.303, subdivision 10, to the Legislative Coordinating Commission as soon
3.22as practicable or by January 15 of the applicable fiscal year, whichever comes first. The
3.23Legislative Coordinating Commission must post submitted information on the Web site
3.24required under section 3.303, subdivision 10, as soon as it becomes available.
3.25(e) Grants funded by the arts and cultural heritage fund must be implemented
3.26according to section 16B.98 and must account for all expenditures of funds. Priority for
3.27grant proposals must be given to proposals involving grants that will be competitively
3.28awarded.
3.29(f) All money from the arts and cultural heritage fund must be for projects located
3.30in Minnesota.
3.31(g) When practicable, a direct recipient of an appropriation from the arts and cultural
3.32heritage fund shall prominently display on the recipient's Web site home page the legacy
3.33logo required under Laws 2009, chapter 172, article 5, section 10, as amended by Laws
3.342010, chapter 361, article 3, section 5, accompanied by the phrase "Click here for more
3.35information." When a person clicks on the legacy logo image, the Web site must direct
4.1the person to a Web page that includes both the contact information that a person may
4.2use to obtain additional information, as well as a link to the Legislative Coordinating
4.3Commission Web site required under section 3.303, subdivision 10.
4.4(h) Future eligibility for money from the arts and cultural heritage fund is contingent
4.5upon a state agency or other recipient satisfying all applicable requirements in this section,
4.6as well as any additional requirements contained in applicable session law.
