1.1A bill for an act
1.2relating to insurance; the Minnesota Comprehensive Health Association;
1.3providing an exception for children to the association's six-month preexisting
1.4condition limitation; making a technical update;amending Minnesota Statutes
1.52010, section 62E.14, subdivision 3, by adding a subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 62E.14, subdivision 3, is amended to read:
1.8    Subd. 3. Preexisting conditions. No person who obtains coverage pursuant to
1.9this section shall be covered for any preexisting condition during the first six months of
1.10coverage under the state plan if the person was diagnosed or treated for that condition
1.11during the 90 days immediately preceding the date the application was received by the
1.12writing carrier, except as provided under subdivisions 3a, 4, 4a, 4b, 4c, 4d, 4e, 4f, 5, 6,
1.13and 7 and section 62E.18.
1.14EFFECTIVE DATE.This section is effective the day following final enactment.

1.15    Sec. 2. Minnesota Statutes 2010, section 62E.14, is amended by adding a subdivision
1.16to read:
1.17    Subd. 4f. Waiver of preexisting conditions; children under age 18. A Minnesota
1.18resident who is otherwise eligible and is under the age of 18 years as of the date of
1.19application, may enroll in the comprehensive health plan with a waiver of the preexisting
1.20condition limitation contained in subdivision 3.
1.21EFFECTIVE DATE.This section is effective the day following final enactment.
