1.1A bill for an act
1.2relating to local government; exempting nonprofit organizations from certain fees
1.3and charges;proposing coding for new law in Minnesota Statutes, chapter 426.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [426.30] NONPROFITS EXEMPT FROM CERTAIN CITY FEES.
1.6    Subdivision 1. Definitions. For the purposes of this section the following terms
1.7have the meanings given them.
1.8(a) "City" means a statutory or home rule charter city.
1.9(b) "Nonprofit organization" means an organization that meets the criteria in section
1.10272.02, subdivision 7, for exemption from property taxation.
1.11    Subd. 2. Exempt from certain fees. A nonprofit organization is exempt from
1.12paying a fee or charge imposed by a city if that fee or charge is for a service provided
1.13by the city and within the most recent five years has been paid for from revenue raised
1.14from the city's property tax levy.
1.15EFFECTIVE DATE.This section is effective August 1, 2013, and applies to
1.16charges or fees imposed on or after that date.
