1.2relating to human services; directing the commissioner of human services to
1.3develop a proposal to create a single administrative structure for the delivery of
1.4medical nonemergency transportation services in the medical assistance program.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. MEDICAL NONEMERGENCY TRANSPORTATION SINGLE
1.7ADMINISTRATIVE STRUCTURE PROPOSAL.
1.8(a) The commissioner of human services shall develop a proposal to create a single
1.9administrative structure for providing medical nonemergency transportation services to
1.10fee-for-service medical assistance recipients. This proposal must consolidate access and
1.11special transportation into one administrative structure with the goal of standardizing
1.12eligibility determination processes, scheduling arrangements, billing procedures, data
1.13collection, and oversight mechanisms in order to enhance coordination, improve
1.14accountability, and lessen confusion.
1.15(b) In developing the proposal, the commissioner shall:
1.16(1) examine the current responsibilities performed by the counties and the
1.17Department of Human Services and consider the shift in costs if these responsibilities are
1.18changed;
1.19(2) identify key performance measures to assess the cost effectiveness of medical
1.20nonemergency transportation statewide, including a process to collect, audit, and report
1.21data;
1.22(3) develop a statewide complaint system for medical assistance recipients using
1.23special transportation;
1.24(4) establish a standardized billing process;
2.1(5) establish a process that provides public input from interested parties before
2.2special transportation eligibility policies are implemented or significantly changed;
2.3(6) establish specific eligibility criteria that include the frequency of eligibility
2.4assessments and the length of time a recipient remains eligible for special transportation;
2.5and
2.6(7) develop a reimbursement method to compensate volunteers for no-load miles
2.7when transporting recipients to or from health-related appointments.
2.8(c) In developing the proposal, the commissioner shall consult with the
2.9commissioner of transportation and representatives of the Minnesota State Council on
2.10Disability, the Minnesota Consortium for Citizens with Disabilities, the Arc of Minnesota,
2.11the Association of Minnesota Counties, and transportation providers.
2.12(d) The commissioner shall submit the proposal and draft legislation necessary for
2.13implementation to the chairs and ranking minority members of the senate and house of
2.14representatives committees or divisions with jurisdiction over health care policy and
2.15finance by January 15, 2012.
