1.3costs of countywide public safety improvements;amending Minnesota Statutes
1.42010, section 383E.21.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 383E.21, is amended to read:
1.7383E.21 BONDING FOR COUNTYWIDE PUBLIC SAFETY
1.8COMMUNICATION SYSTEMS.
1.9 Subdivision 1. Authority to incur debt. (a) To finance the cost of designing,
1.10constructing, and acquiring countywide public safetycommunication system infrastructure
1.11improvements and equipment, including real and personal property, benefiting both Anoka
1.12County and the municipalities located within Anoka County, the governing body of Anoka
1.13County may issue:
1.14(1) capital improvement bonds under the provisions of section 373.40 as if the
1.15infrastructure and equipment qualified as a "capital improvement" within the meaning of
1.16section 373.40, subdivision 1, paragraph (b); and
1.17(2) capital notes under the provisions of section 373.01, subdivision 3, as if the
1.18equipment qualified as "capital equipment" within the meaning of section 373.01,
1.19subdivision 3.
1.20(b)The original principal amount of the bonds and the capital notes issued under this
1.21section may not exceed $12,500,000. Any bonds or notes issued pursuant to this section
1.22must only be issued after approval by a majority vote of the Anoka County Joint Law
1.23Enforcement Council, a joint powers board.
2.1 Subd. 2. Treatment of levy. Notwithstanding sections 275.065, subdivision 3, and
2.2276.04, the county may report the tax attributable to any levy to pay principal and interest
2.3on bonds or notes issued under this section as a separate line item on the proposed property
2.4tax notice and the property tax statement. Bonds or notes issued by Anoka County under
2.5this section must not be included in the net debt of Anoka County.
2.6 Subd. 3. Expiration. This section expiresten years after the first year in which the
2.7county issues a note or bond under this section on January 1, 2040. The county may not
2.8issue a bond or note under this section with a maturity or payment date after the expiration
2.9date of this section. No property tax may be levied under this section for taxes payable in
2.10a calendar year after the calendar year in which this section expires. Expiration of this
2.11section does not affect the obligation to pay or the authority to collect taxes levied under
2.12this section before its expiration.
