1.1A bill for an act
1.2relating to motor vehicles; providing standards for issuing any special license
1.3plates for vehicles; authorizing special eagle scout plates; proposing coding for
1.4new law in Minnesota Statutes, chapter 168.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [168.1295] CERTAIN SPECIAL PLATES; UNIFORM
1.7REQUIREMENTS.
1.8    Subdivision 1. Definition. For purposes of this section, the following terms have
1.9the meanings given them:
1.10(1) "eligible for the special plates" means that an individual meets eligibility
1.11requirements, if any, established by a provision of this chapter that specifically authorizes
1.12the special plates; and
1.13(2) "special plates" means special plates, as defined in section 168.002, subdivision
1.1431a, or a single motorcycle plate, authorized under section 168.1299.
1.15    Subd. 2. General requirements; fees. The commissioner shall issue special plates
1.16to an applicant who:
1.17(1) is eligible for the special plates;
1.18(2) is a registered owner of a passenger automobile, one-ton pickup truck,
1.19motorcycle, or recreational motor vehicle;
1.20(3) pays the fee as required under section 168.12, subdivision 5;
1.21(4) pays the registration tax as required under section 168.013;
1.22(5) pays any other fees required under this chapter; and
1.23(6) complies with this chapter and rules governing the registration of motor vehicles
1.24and licensing of drivers.
2.1    Subd. 3. Transfers; fee. (a) On application to the commissioner and payment of a
2.2transfer fee of $5, the registered owner of a vehicle bearing the special plates may transfer
2.3the plates to another motor vehicle if the subsequent vehicle is:
2.4(1) qualified to bear the special plates under subdivision 2, clause (2); and
2.5(2) registered to the same individual to whom the special plates were originally
2.6issued.
2.7(b) No plate may be transferred to a motorcycle unless it was originally issued
2.8for a motorcycle, and no plate originally issued for a motorcycle may be transferred to
2.9a vehicle that is not another motorcycle.
2.10    Subd. 4. Plate removal, invalidation, replacement. (a) An individual may use
2.11special plates only during the period that the individual remains eligible for the special
2.12plates. When the individual to whom the special plates were issued ceases to be eligible
2.13for the special plates, the individual shall remove the special plates from the vehicle.
2.14(b) When ownership of a motor vehicle bearing special plates is transferred, if the
2.15individual taking possession of the vehicle is not qualified, that person shall remove
2.16the special plates from the motor vehicle.
2.17(c) If the commissioner receives written notification that an individual is no longer
2.18eligible for the special plates, the commissioner shall invalidate the plates and notify the
2.19individual of this action. The individual may retain the plates only upon demonstrating
2.20compliance with this section and that the person is eligible for the special plates.
2.21(d) Upon removal or invalidation of the special plates, the owner of the motor
2.22vehicle, or the individual taking possession of the vehicle in the case of transfer of motor
2.23vehicle ownership, shall obtain plates for the proper registration classification for the
2.24motor vehicle.
2.25    Subd. 5. Record keeping. The commissioner shall maintain a record of the annual
2.26number of special plates issued under this chapter.
2.27    Subd. 6. Rulemaking. The commissioner may adopt rules governing the issuance
2.28and use of the special plates.

2.29    Sec. 2. [168.1299] SPECIAL EAGLE SCOUT PLATES.
2.30    Subdivision 1. Plate issuance. The commissioner shall issue special eagle scout
2.31plates to an applicant who (1) meets the requirements under section 168.1295, and (2)
2.32is an eagle scout and provides documentation of eagle scout status, as determined by
2.33the commissioner.
2.34    Subd. 2. Design. The commissioner shall create a design or emblem for the special
2.35plate in consultation with interested local councils of Boy Scouts of America located in
3.1Minnesota. The special plate must bear the inscription "EAGLE SCOUT" at the bottom of
3.2the plate.
3.3    Subd. 3. Compliance with other law. License plates issued under this section are
3.4not subject to section 168.1293, subdivision 2.
