1.1A bill for an act
1.2relating to local government; authorizing local governments to transfer cemetery
1.3property to a tribal cemetery association;amending Minnesota Statutes 2012,
1.4section 306.02, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 306.02, subdivision 2, is amended to read:
1.7    Subd. 2. Transfer by local government unit. Cemetery land and property or a
1.8public burial ground owned or controlled by a town, statutory or home rule charter city, or
1.9county may be transferred by deed or otherwise to an existing cemetery association or
1.10corporation or one, a cemetery association or corporation formed under this chapter, or
1.11a cemetery association or corporation formed under the laws of a federally recognized
1.12Indian tribe in Minnesota. The transfer may be with or without condition, as determined
1.13by the town, statutory or home rule charter city, or county. The town, statutory or home
1.14rule charter city, or county may, as a part of the transaction, enter into a contract or
1.15agreement with the cemetery association to provide for the management and maintenance
1.16of the cemetery, for the sale of lots or land in the cemetery, and for those other matters
1.17concerning the care and control of the cemetery as the town, statutory or home rule charter
1.18city, or county considers advisable.
1.19EFFECTIVE DATE.This section is effective the day following final enactment.
