1.1A bill for an act
1.2relating to legislative procedure; prohibiting final passage of a bill or conference
1.3committee report on the day it is received by a body, with certain exceptions;
1.4proposing coding for new law in Minnesota Statutes, chapter 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [3.193] PREVENTION OF UNINFORMED LEGISLATORS.
1.7    Subdivision 1. Body not to act on day bill received. A bill or a conference
1.8committee report may not be considered for final passage during the same legislative day
1.9on which it was reported to the body, except by the affirmative vote of two-thirds of the
1.10members of the body receiving the bill or report. On the final legislative day before a
1.11constitutionally required adjournment, this requirement may be waived by the affirmative
1.12vote of 40 members of the senate for senate consideration or the affirmative vote of 80
1.13members of the house of representatives for house consideration, or by an executive order
1.14of the governor that refers to the specific senate file number or house file number. If this
1.15requirement is waived, the body must not act on final passage before a minimum of one
1.16hour has passed from the time the bill or conference committee report was received by
1.17the body.
1.18    Subd. 2. Amendments. Amending substantially equivalent provisions from a
1.19noncomplying bill or conference committee report onto a complying bill for the purpose
1.20of evading the requirements of subdivision 1 is also a violation of subdivision 1.
1.21    Subd. 3. Accountability. If a body violates this section, the member presiding at
1.22the time of the violation is personally accountable for the violation. No other member is
1.23responsible or accountable for a violation.
