1.1A bill for an act
1.2relating to emergency medical services; establishing an interstate highway
1.3emergency response reimbursement pilot program; requiring a report;
1.4appropriating money;proposing coding for new law in Minnesota Statutes,
1.5chapter 144E.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. [144E.51] INTERSTATE HIGHWAY EMERGENCY RESPONSE
1.8REIMBURSEMENT PILOT PROGRAM.
1.9    Subdivision 1. Established. The board shall establish and administer a pilot
1.10program to reimburse an eligible ambulance service for unrecovered costs resulting from
1.11providing emergency services to persons on interstate highways in the state.
1.12    Subd. 2. Eligibility. In order to be eligible for reimbursement under this program,
1.13the ambulance service must meet the following criteria:
1.14(1) be a licensed ambulance service with the majority of its personnel being
1.15volunteer ambulance attendants, as defined in section 144E.001, subdivision 15;
1.16(2) be located in Washington County;
1.17(3) have an interstate highway that runs through its primary service area;
1.18(4) serve a primary service area immediately adjacent to Wisconsin; and
1.19(5) submit evidence to the board on a quarterly basis demonstrating that it (i)
1.20provided emergency services to an out-of-state resident on an interstate highway, issued
1.21the patient a claim for such service, and was unable to collect on the debt, or (ii) provided
1.22emergency services on an interstate highway to an unidentified patient and was unable to
1.23collect on the debt.
2.1    Subd. 3. Reimbursement. Upon receipt of a request for reimbursement from
2.2an eligible ambulance service pursuant to subdivision 2, the board may determine the
2.3percentage of eligible claims to be reimbursed based on available funding.

2.4    Sec. 2. INTERSTATE HIGHWAY EMERGENCY RESPONSE
2.5REIMBURSEMENT PILOT PROGRAM REPORT.
2.6By January 15, 2013, the emergency medical services regulatory board and the
2.7Minnesota Ambulance Association must report to the governor and to the legislature the
2.8impediments to collection of uncompensated emergency care provided by Minnesota
2.9ambulance services provided to nonresidents. The report must be based on information
2.10gathered by an ambulance service participating in the pilot program, established under
2.11Minnesota Statutes, section 144E.51, and must consider data submitted by other
2.12ambulance services in the state that have an interstate highway within their primary
2.13service area and experience significant uncompensated care originating from nonresidents.
2.14The report must include options for addressing future collection of unpaid charges
2.15generated by nonresidents.

2.16    Sec. 3. APPROPRIATION.
2.17$....... is appropriated from the general fund in fiscal year 2013 to the Emergency
2.18Medical Services Regulatory Board for the interstate highway emergency response
2.19reimbursement pilot program, established under Minnesota Statutes, section 144E.51. Of
2.20this appropriation, $....... is for the board to administer the pilot program. Funds are
2.21available until expended.

2.22    Sec. 4. EFFECTIVE DATE.
2.23Sections 1 to 3 are effective July 1, 2012.
