1.1A bill for an act
1.2relating to charitable solicitations; regulating public disclosures of certain
1.3charitable organization salaries;amending Minnesota Statutes 2012, section
1.4309.556, subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 309.556, subdivision 1, is amended to read:
1.7    Subdivision 1. Identity of organization; percentage of deductibility; description
1.8of program. (a) Prior to orally requesting a contribution or contemporaneously with a
1.9written request for a contribution, the following information shall be clearly disclosed:
1.10(a) (1) the name and location by city and state of each charitable organization on
1.11behalf of which the solicitation is made;
1.12(b) (2) the tax deductibility of the contribution; and
1.13(c) (3) a description of the charitable program for which the solicitation campaign
1.14is being carried out; and, if different, a description of the programs and activities of the
1.15organization on whose behalf the solicitation campaign is being carried out.; and
1.16(4) that a list of the five highest paid directors, officers, and employees of the
1.17organization and related organizations, as included in the annual report pursuant to
1.18section 309.53, may be obtained from each charitable organization on whose behalf the
1.19solicitation is made. A toll-free telephone number, e-mail address, or Web site URL
1.20address where this information may be obtained must also be included in the disclosure.
1.21(b) If the solicitation is made by direct personal contact, the required information
1.22shall also be disclosed prominently on a written document which shall be exhibited to
1.23the person solicited. If the solicitation is made by radio, television, letter, telephone, or
1.24any other means not involving direct personal contact, the required information shall
2.1be clearly disclosed in the solicitation. This subdivision also applies to a charitable
2.2organization exempt from registration and reporting requirements under section 309.515,
2.3subdivision 1, paragraph (c).
