1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [86B.215] PUBLIC BEACHES; LIFEGUARDS.
1.7 Subdivision 1. Definition. For the purposes of this section, "public swimming beach"
1.8means an area abutting a body of water, other than a swimming pool governed by section
1.9144.1222, owned or operated by a state agency, whether directly or under agreement with
1.10another public or private entity, intended to be open to the public for swimming.
1.11 Subd. 2. Lifeguards. If a state agency provides for lifeguards to be present at a
1.12public swimming beach, each lifeguard must be certified in first aid and adult, child,
1.13and infant cardiopulmonary resuscitation, have Red Cross lifeguard certification or the
1.14equivalent, and be responsible for the supervision and safety of persons at the public
1.15swimming beach while on duty.
1.16 Subd. 3. Citation. This section may be cited as "Tony's Law."
1.17EFFECTIVE DATE.This section is effective January 1, 2015.

1.20(1) "political subdivision" means a statutory or home rule charter city, county, town,
1.21or other political subdivision; and
1.22(2) "public swimming beach" means an area abutting a body of water, other than
1.23a swimming pool governed by section 144.1222, owned or operated by the political
2.1subdivision, whether directly or under agreement with another public or private entity,
2.2intended to be open to the public for swimming.
2.3 Subd. 2. Lifeguards. If a political subdivision provides for lifeguards to be present
2.4at a public swimming beach, each lifeguard must be certified in first aid and adult, child,
2.5and infant cardiopulmonary resuscitation, have Red Cross lifeguard certification or the
2.6equivalent, and be responsible for the supervision and safety of persons at the public
2.7swimming beach while on duty.
