1.1A bill for an act
1.2relating to health; establishing a working group to make recommendations on
1.3methods to reduce administrative burdens for nursing homes in the state.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. RECOMMENDATIONS TO REDUCE ADMINISTRATIVE
1.6BURDENS; NURSING HOMES.
1.7    Subdivision 1. Establishment; members. The commissioner of health must
1.8convene a working group to study and make recommendations to the legislature as to
1.9possible methods for reducing administrative burdens for nursing homes in the state. The
1.10working group must consist of no more than ten members including, but not limited to,
1.11the following:
1.12(1) at least one member appointed by the commissioner of health;
1.13(2) at least one member appointed by the commissioner of human services;
1.14(3) at least three members representing nursing homes, including at least one nursing
1.15home administrator;
1.16(4) at least one member appointed by the Board on Aging; and
1.17(5) at least one member appointed by the ombudsman for long-term care.
1.18The appointing authorities under this subdivision must complete their appointments
1.19by June 1, 2012.
1.20    Subd. 2. Duties; recommendations. The working group established under this
1.21section must study the current state and federal reporting and inspection requirements for
1.22nursing homes in this state and make recommendations for how these reports can be
1.23consolidated or eliminated to reduce administrative burdens on nursing homes in the
1.24state without jeopardizing patient safety.
2.1    Subd. 3. Meetings. The commissioner of health must convene the first meeting by
2.2June 1, 2012. Meetings must be open to the public. The members of the working group
2.3shall select a chair from their membership at the first meeting.
2.4    Subd. 4. Report. By December 15, 2012, the commissioner of health, with the
2.5commissioner of human services, must submit to the legislature a report providing the
2.6findings and recommendations of the working group. The report must include drafts
2.7of any statutory or rule changes that are needed to implement the working group's
2.8recommendations.
2.9    Subd. 5. Expiration. This section expires when the report required under
2.10subdivision 4 is submitted.
2.11EFFECTIVE DATE.This section is effective the day following final enactment.
