1.4Statutes 2010, section 62U.02, subdivision 5.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 62U.02, subdivision 5, is amended to read:
1.7 Subd. 5. Implementation. (a) By January 1, 2010, health plan companies shall use
1.8the standardized quality measures established under this section and shall not require
1.9providers to use and report health plan company-specific quality and outcome measures.
1.10 (b) By July 1, 2010, the commissioner of management and budget shall implement
1.11this incentive payment system for all participants in the state employee group insurance
1.12program.
1.13(c) The commissioner must develop an exemption form by which providers may
1.14refuse, without penalty, to participate in the quality measurement and incentive payment
1.15programs provided under this section and section 62U.04. The commissioner must
1.16make the form available to providers via the Department of Health Web site by July 1,
1.172012. Upon receipt of a completed form, the commissioner and health plan companies
1.18must cease any quality measurement and incentive payment activity under this section or
1.19section 62U.04 relative to that provider.
