1.1A bill for an act
1.2relating to economic development; transferring unused appropriations to an
1.3account for the small cities development program to be used by communities
1.4affected by storms and flooding in 2012.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. TRANSFER.
1.7(a) The unexpended and unencumbered balance of the appropriations in Laws 2012,
1.8First Special Session chapter 1, article 1, section 5, as amended by Laws 2012, First
1.9Special Session chapter 2, section 1; and Laws 2012 First Special Session chapter 1,
1.10article 1, section 7, estimated to be $......, are transferred to an account in the state treasury
1.11to be administered by the commissioner of employment and economic development in
1.12accordance with the provisions of the Small Cities Development Block Grant Program
1.13under Minnesota Rules, chapter 4300.
1.14(b) Money transferred to this account is dedicated to provide relief for communities
1.15affected by the storms and flooding that occurred on or after June 14, 2012, in the area in
1.16Minnesota designated under Presidential Declaration of a Major Disaster FEMA-4069-DR,
1.17whether included in the original declaration or added later by federal government action.
1.18(c) Notwithstanding any law or rule to the contrary, money transferred to this
1.19account may also be used by the commissioner for grants to local units of government as
1.20a source of interim financing for local units of government having cash flow problems
1.21due to funding public infrastructure projects that are reimbursed by Federal Emergency
1.22Management Agency (FEMA) funds.
1.23(d) Notwithstanding Minnesota Statutes, section 16A.28, money transferred to this
1.24account does not lapse and is available until spent.
